This policy outlines your rights and obligations regarding orders placed on dr-kim.com. Please read it carefully before making a purchase.

1. Order Cancellation Before Shipment

You may cancel your order without giving any reason at any time before we have dispatched the goods and sent you a shipment confirmation email.

To cancel an order before shipment, please contact us immediately at sales@dr-kim.com with your order number.

If the order is cancelled before shipment, we will issue a full refund to your original payment method via our payment processor, Stripe. The refund will be processed without undue delay and no later than 14 days from the day we confirm your cancellation.

2. Right of Withdrawal (14-Day "Cooling-Off" Period)

As a consumer based in the European Union, you have the legal right to withdraw from the contract for the purchase of our wearable headsets within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you (or a third party you nominate) takes physical possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision by making a clear statement (e.g., a letter sent by post or an email). You may use the model withdrawal form provided at the end of this policy, but it is not obligatory.

3. Effects of Withdrawal & Refund Conditions

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of standard delivery (least expensive common carrier method we offer).

We will process the refund without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.

We will issue the refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

4. Your Responsibilities & Deductions for Diminished Value

We understand that you need to inspect the product. However, to receive a full refund, the goods must be returned in their original, unused, and resalable condition. This means:

  • The product (the full headset, including all mounting components) must be in its original packaging, including all protective materials and boxes.
  • All accessories, documentation, and protective films must be intact and unused.
  • The product must show no signs of wear, installation, or damage.

We are entitled to make a deduction from the reimbursement for any diminution in the value of the goods if the product has been handled beyond what is necessary to establish its nature, characteristics, and functioning.

For high-value, precision optical equipment like our headsets, "necessary handling" is strictly limited to unboxing and visual inspection. It does NOT include:

  • Assembling or mounting the headset.
  • Wearing or adjusting the headset on a person.
  • Connecting it to a power source beyond a simple functional check that does not contribute to wear.
  • Installing or changing optics, if this leaves any marks or signs of use.
  • Any form of outdoor use, testing, or calibration.

If the product is returned in a used, damaged, or otherwise diminished-value state, we reserve the right to refuse a full refund. We may instead:

  1. Refuse the return entirely and send the product back to you at your cost, or
  2. Offer a partial refund, deducting a significant amount (e.g., 15-50% of the product price) to account for the loss of value, as the product can no longer be sold as new.

We will inform you of our decision and the justification for any deduction immediately upon inspection of the returned item.

5. Return Shipping Costs & Procedure

  • You are responsible for the direct cost of returning the goods to us.
  • The risk of loss or damage to the returned goods is on you until they are received at our warehouse. We strongly recommend you use a tracked and insured shipping service for the full value of the product. We cannot be held responsible for items lost or damaged in transit back to us.
  • Please contact us at sales@dr-kim.com for the correct return address before shipping anything back.
  • Proof of postage or shipment is not proof of receipt by us.

6. Exceptions to the Right of Withdrawal

According to EU law, the right of withdrawal does not apply to the following:

  • Customized or Personalized Goods: This includes any headsets that have been specifically configured with non-standard optics, custom engravings, or any other modifications made to your specifications. Once production on a custom order has begun, it cannot be cancelled or returned.

7. Warranty & Defective Goods

This cancellation policy is separate from your legal rights relating to faulty or misdescribed goods. We provide a legal 12-month (1-year) warranty on all our products for defects in materials and workmanship.

If you believe your product is defective, please contact us immediately at sales@dr-kim.com. We will troubleshoot the issue with you. If a fault is confirmed, we will repair or replace the item, or offer a full refund, in accordance with Czech and EU consumer law. In case of a valid warranty claim, we will cover the return shipping costs.

8. General Provisions

  • Payment Processing: All payments are securely processed by Stripe. Your payment data is handled in accordance with Stripe's privacy policy. Refunds will be issued to the original payment method.
  • Jurisdiction: Any disputes will be subject to the exclusive jurisdiction of the courts of the Czech Republic.
